Purchase regulations of the Top Ten Sp. online store. z o. o.
§1 General Terms and Conditions
The owner of the online store located at the domain top-ten.com.pl is the company:

1. Using the Top Ten online store implies acceptance of these regulations.
2. The party making purchases in the Top Ten Sp. z o.o. online store, hereinafter referred to as the Customer, is either an individual with full legal capacity or a business entity.
3. All quoted prices are gross prices. The price given in the order form is binding at the moment of placing the order. The price of a product that is unavailable at the time of the order may change.
4. In the case of promotional products whose quantity is limited, order fulfillment is dependent on the sequence of received orders.
5. Top Ten Sp. z o.o. reserves the right to change the prices of products offered at any time, introduce new products and withdraw them from the offer, conduct and revoke promotional campaigns regardless of inventory levels at the time of order placement.
§2 Order Placement and Fulfillment Procedure
1. Orders can be placed by using the function of adding a product to the cart, and then by clicking the “place order” button. To place an order correctly, it will be necessary to create a user account, through which one can also monitor the order status.
2. After placing the order, the customer receives its confirmation by electronic means.
3. A fundamental condition for the execution of the order is the correct filling in of contact details, along with a correct and existing email address. Orders with incorrectly filled contact details will not be considered.
4. Top Ten Sp. z o.o. is not responsible for errors made by the Customer in the order form, as a result of which the shipment did not reach the recipient, as well as for an unjustified refusal to receive the shipment. The costs associated with resending and handling such an order are borne by the Customer.
5. In the event of circumstances preventing the complete or temporary execution of an order, Top Ten Sp. z o.o. reserves the right to suspend the execution of the order – it undertakes to notify the Customer of the situation without delay.
6. The fulfillment of the order begins at the moment the payment is recorded on the bank account of Top Ten Sp. z o.o.
7. The shipment of goods takes place within 7 working days from the start of the order processing.
8. The condition for the execution of the order is the availability of the product in the warehouse of Top Ten Sp. z o.o. In the event of unavailability of part of the goods covered by the order, the Customer is informed about the status of the order and makes a decision on how to proceed. In such a case, the Customer has 2 days to make a decision and confirm the order. After this period, the lack of the Customer’s decision is equivalent to the withdrawal from the placed order.
9. Modification of the order is possible until the order has not yet been sent by courier. Changing the delivery address after the shipment has been processed involves an additional cost.
10. The seller reserves the right to verify the order. In cases that raise justified concerns or when these Regulations are not adhered to, Top Ten Sp. z o.o. may withdraw from fulfilling the order.
§3. Delivery Terms
1. The ordered goods are delivered via the courier company InPost. The cost of shipping 1 package, depending on the selected option, is:
– InPost Courier – 17 PLN gross (only in Poland)
– Paczkomat® – 11 PLN gross (only in Poland)
The shipping cost is borne by the Customer.
§4. Payments
1. The accepted form of payment in the Top Ten Sp. z o.o. online store is prepayment or online payment through the Przelewy24 transaction service.

The transfer title should include: order number and the name and surname of the person placing the order or the name of the ordering company.
§5. Receipt / VAT Invoice
1. With the order, a receipt is issued (in the case of individuals) or a VAT invoice (in the case of business entities, provided that the necessary data is filled in the registration form: company name, address, VAT number, etc.)
§6. Withdrawal from the Contract / Complaints
1. The Customer has the right to withdraw from the contract within 14 days of receiving the shipment, without giving any reason, within the framework of withdrawal from the contract according tothe principles resulting from the regulations concerning distance contracts. The intention to withdraw from the contract should be sent to the address sklep@top-ten.com.pl. The cost of the return shipment in case of withdrawal from the contract is borne by the Customer. The goods must be returned along with proof of purchase to the address: Top Ten Sp. z o.o., 10-683 Olsztyn, Augustowska 20. The returned product must be in its original, undamaged packaging, with complete contents, and the product itself and accessories cannot be damaged or show any signs of use. Detailed information is regulated by the Act of March 2, 2000, on the protection of certain consumer rights and on liability for damage caused by a dangerous product (Journal of Laws of March 31, 2000).
2. In the event of withdrawal from the contract, the price paid by the Customer, reduced by any shipping costs, is subject to refund within 7 days from the day Top Ten Sp. z o.o. receives the returned goods. The refund of the due amount will be made in the same way as the Customer made the payment.
3. All products sold by Top Ten Sp. z o.o. are brand new and functional. In the case of defective goods, factory damaged or incomplete, we guarantee their replacement with goods free from defects, provided that the damage is reported within 5 working days from the date of receiving the shipment. In case of stock exhaustion, Top Ten Sp. z o.o. guarantees an exchange for other products or a refund of money.
4. The Customer is obliged to check the shipment for mechanical damage that may occur during transport. Checking the shipment upon receipt and making a protocol in the presence of a courier is a necessary condition for considering any claims of the Customer for damage or theft of the shipment in transit.
5. If the Customer notices technical defects or other irregularities in the received goods, a complaint should be submitted to the address sklep@top-ten.com.pl, and the goods under complaint should be returned along with proof of purchase to the address: Top Ten Sp. z o.o., 10-683 Olsztyn, Augustowska 20. The costs of shipping the claimed goods (up to the amount of 15 PLN gross) and the costs of the claimed goods will be refunded to the Customer after considering the complaint, within 14 days from the day Top Ten Sp. z o.o. receives the claimed goods. In the event that it is not possible for the customer to return the defective goods at the above price, Top Ten Sp. z o.o., upon receiving the appropriate information at sklep@top-ten.com.pl, will commission the collection of the shipment by the courier company InPost.
§7. Final Provisions
1. The Customer agrees to the processing and storing in electronic form of their personal data provided during the registration process in the Store according to the Act of August 29, 1997, on the protection of personal data (consolidated text: Journal of Laws from 2002, no. 101, item 926, as amended). Only Top Ten Sp. z o.o. has access to the data, and it does not transfer this data to third parties. All Customers have access to their data – they can verify, modify, and delete it. Top Ten Sp. z o.o. reserves the right to use contact data for its own marketing research or promotional purposes.
2. The content of the Top Ten Sp. z o.o. online store does not constitute a commercial offer within the meaning of the Civil Code.
3. Despite due diligence, errors that may occur in the offer presented in the Top Ten Sp. z o.o. online store cannot be the basis for claims against Top Ten Sp. z o.o. In case of doubts concerning the presented offer, please contact Top Ten Sp. z o.o.
4. In matters not regulated by this document, the relevant provisions of the Civil Code apply.
5. By registering in the store or placing an order, the Customer accepts the above regulations.
6. The exclusive owner of copyright to product descriptions, photographs, and all other materials found on the online store pages is Top Ten Sp. z o.o. In accordance with the Act of February 4, 1994, on copyright law, any copying, distribution (in part or in full) of the descriptions, photos, and drawings posted without the owner’s consent will be treated as a violation of the copyright owner’s rights.
